NOTICE OF FINANCIAL INCENTIVE

This Notice of Financial Incentive explains to consumers the material terms of a financial incentive or price or service difference we offer and its relationship to our collection, retention, sale or sharing, of personal information.  

Under the California Consumer Privacy Act, a business may offer financial incentives, including payments to consumers as compensation, for the collection, retention, sale, or sharing of their personal information. A business may offer a different price, rate, level, or quality of goods or services to the consumer if that price or difference is reasonably related to the value the consumer’s data provides to the business.

Description of Financial Incentive  

TextNow offers a financial incentive program known as Vibe Check. Vibe Check is a voluntary daily poll presented within the TextNow Rewards experience. Each day, participating consumers are shown a single binary question that is consistent across all consumers. Consumers may select one of two response options to submit their vote. Upon submission, consumers earn points and are shown aggregated community level results. Participation is entirely optional and not required to access TextNow services. 

The material terms of the program are: Participation in Vibe Check permits TextNow to collect a consumer’s explicit poll responses, associated in app interaction events, and derived interest categories mapped to the IAB audience taxonomy. This information is used solely to enhance advertising relevance and advertising measurement. No sensitive personal information is collected through this program, and participation does not affect access to services, pricing, or eligibility for any TextNow offering. The value of the consumer’s data collected through participation is limited and is reasonably related to the loyalty points awarded in exchange for participation.  

What is Personal Information 

The CCPA defines personal information as “information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” 

The categories of personal information that are or may be used by the program are: 

  • Commercial information: records of personal property, products or services purchased, obtained, or considered or other purchasing or consuming histories or tendencies. 
  • Demographic information: such as, marital status, education level, and household information 
  • Inferences drawn from any of the information in any other category to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.  

The personal information collected through Vibe Check is associated with a consumer’s existing TextNow account or unique identifier. 

How We Calculate the Value of Consumer Data 

TextNow has determined in good faith that the incentive offered through Vibe Check is reasonably related to the value of the consumer data to TextNow. Participation in Vibe Check supports advertising revenue within the Rewards experience. TextNow estimates this value based on internal analysis of Rewards program performance and advertising revenue associated with consumer engagement. The loyalty points awarded for participation are designed to correspond proportionally to that estimate. 

How to Opt-in to the Financial Incentive  

Consumers opt in to the Vibe Check financial incentive program by voluntarily selecting and submitting a response to a Vibe Check poll question within the TextNow Rewards experience. By submitting a poll response, the consumer provides affirmative consent to participate in the program. Loyalty points are awarded only after a response is submitted. 

Exercising Your Right to Withdraw at Any Time  
Consumers have the right to withdraw from the financial incentive at any time without penalty or impact on access to TextNow services.  

Consumers may withdraw by ceasing participation in Vibe Check at any time. Consumers who choose not to answer or submit future poll questions, including by skipping the poll, will no longer participate in the program and will not receive additional loyalty points. 

Consumers may request deletion of personal information collected through Vibe Check by submitting a request through TextNow’s existing privacy rights request process.  

Changes to Notice or Privacy Policy 

We reserve the right to amend this Notice of Financial Incentive at our discretion at any time. Your continued use of our website following the posting of changes to our Notice, or to our Privacy Policy, constitutes your acceptance of such changes.
